Sunbird Operator Terms of Service

These terms govern your use of Sunbird as a salon or service business (“Operator”, “you”). If you book appointments as a customer of a salon, the Consumer Terms of Use apply to you instead.
By creating an account or using Sunbird, you agree to these terms. If you accept on behalf of a business, you confirm you are authorised to bind it.
1. Who we are
Sunbird is operated by Sunbird Digital (Pty) Ltd, Registration No. 2015/359496/07 (“Sunbird”, “we”, “us”), a company incorporated in South Africa.
2. The Service
Sunbird provides software for managing appointments, clients, staff, stock, point-of-sale, payments and WhatsApp-based booking for your business. We provide the software; you run your own business on it. We are not a party to the bookings, sales or service relationships between you and your clients.
3. Your account
You must provide accurate information, keep your login credentials secure, and are responsible for everything done under your account, including by your staff. Tell us promptly of any unauthorised use.
4. Subscription, fees and billing
- Sunbird is offered on a monthly subscription, billed in advance in South African Rand (ZAR) through our payment processor, Paystack.
- New Operators may receive a 14-day free trial. If you do not cancel before the trial ends, your paid subscription begins automatically.
- Subscription plans and their prices are shown in the app before you subscribe.
- Fees are exclusive of VAT unless stated otherwise; VAT is added where applicable.
- We may change fees on 30 days’ notice; changes take effect at your next renewal.
- Failed or overdue payments may lead to suspension or downgrade of the Service after reasonable notice.
5. Cancellation and termination
- You may cancel at any time, effective at the end of your current paid period. Cancellation stops future billing; fees already paid are not refunded on a pro-rata basis, except where the law requires otherwise.
- We may suspend or terminate your account for material breach of these terms, unpaid fees, or unlawful or abusive use, with reasonable notice where practicable.
- On termination you may export your data for a reasonable period; after that we delete or de-identify it, subject to legal retention obligations and the Data-Processing Addendum.
6. Acceptable use
You will not use Sunbird to: break the law; infringe anyone’s rights; send unlawful or unconsented marketing; upload malicious code; probe, scrape or attack the Service; or resell or white-label it without our written agreement. You are responsible for the lawfulness of the content and client data you put into the Service.
7. Your data-protection responsibilities
Your clients’ personal information belongs to your business, and for that information you are the responsible party under POPIA and Sunbird is your operator. You must have a lawful basis to collect and use your clients’ data, obtain any consents required (including for direct marketing and for health/allergy information), and respond to your clients’ data-subject requests. Our handling of that data on your behalf is governed by the Data-Processing Addendum, which forms part of these terms.
8. Our data and content
- Your data stays yours. You retain all rights to the client and business data you put into Sunbird. You grant us the licence needed to host and process it to provide the Service and as set out in the Data-Processing Addendum.
- De-identified improvement. We may use de-identified and aggregated data (data that does not identify you or any individual) to operate, secure, analyse and improve the Service.
- Our intellectual property. Sunbird, its software, design and brand are ours or our licensors’. These terms grant you a limited, non-exclusive, non-transferable right to use the Service while your subscription is active. The product name “Sunbird” and related marks remain ours.
9. Third-party services
Sunbird relies on third parties, including WhatsApp/Infobip for messaging, Paystack for payments, and others listed in our Privacy Policy. Your use of features that depend on them is also subject to their terms, and we are not responsible for their acts or outages beyond our reasonable control.
10. Availability and support
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. The Service is provided without a formal service-level agreement. We may modify or discontinue features with reasonable notice.
11. Warranties and disclaimers
To the extent permitted by law, the Service is provided “as is” and we disclaim implied warranties not expressly given here. Nothing in these terms excludes or limits any right you have under the Consumer Protection Act 68 of 2008 or other law that cannot lawfully be excluded.
12. Limitation of liability
To the extent permitted by law, and except for liability that cannot be limited (including for death or personal injury caused by negligence, or fraud):
- neither party is liable for indirect, incidental or consequential loss, or loss of profit, revenue, goodwill or data; and
- our total liability arising out of or in connection with the Service is capped at the fees you paid us in the 12 months before the event giving rise to the claim.
13. Indemnity
You will indemnify us against claims arising from your unlawful use of the Service or your breach of your data-protection responsibilities to your clients.
14. Changes to these terms
We may update these terms. We will post the updated version and, for significant changes, give reasonable notice. Continuing to use the Service after a change means you accept the updated terms.
15. Governing law and disputes
These terms are governed by the law of the Republic of South Africa, and you and we submit to the jurisdiction of its courts. We will try to resolve disputes informally first.
16. General
If any provision is unenforceable, the rest stands. Our not enforcing a right is not a waiver of it. You may not assign these terms without our consent; we may assign them in connection with a business transfer. These terms, together with the Data-Processing Addendum and Privacy Policy, are the whole agreement between us on this subject.
