Sunbird Consumer Terms of Use

These terms apply when you use Sunbird to find a salon and book an appointment, whether on the web or through WhatsApp. By using the booking service you agree to them. Please also read our Privacy Policy, which explains how your information is handled.


1. Who we are, and what Sunbird does

Sunbird is operated by Sunbird Digital (Pty) Ltd, Registration No. 2015/359496/07, a company incorporated in South Africa (“Sunbird”, “we”, “us”). Sunbird is a booking platform: we help you discover salons and make, change and keep track of appointments, including through a WhatsApp assistant that uses AI to understand your messages.

Your appointment is with the salon, not with Sunbird. The salon provides the service you book, sets its own prices, deposit rules, cancellation and no-show policies, and is responsible for the service it delivers. We are not a party to that arrangement and do not provide salon services ourselves.

2. Booking through WhatsApp and the AI assistant

When you message the booking assistant, an AI model helps interpret your request and suggest times. The assistant can make mistakes, so please check the details (salon, service, date, time and price) in any confirmation before relying on them. A booking is only made once you receive a confirmation.

3. Deposits, cancellations and no-shows

Some salons require a deposit to confirm a booking, and set their own cancellation and no-show rules. These are the salon’s terms, shown to you at the time of booking, and you should read them. Deposit payments are processed through our payment provider, Paystack, and are collected on the salon’s behalf — the salon, not Sunbird, decides whether a deposit is refundable in a given case. If you believe a deposit should be refunded, raise it with the salon first; we will help facilitate a refund the salon authorises and will pass on disputes we cannot resolve. Nothing here limits any refund right you have under applicable law, including the Consumer Protection Act.

4. Your information

We handle your personal information as described in our Privacy Policy. In short: we use it to make and manage your bookings and to send you booking messages; where you record allergies or health notes so a salon can serve you safely, we treat that as sensitive information and use it only for that purpose. You can ask for a copy of your data, or ask us to delete it, in the app or by contacting us. You can opt out of marketing messages at any time, and opting out will not stop the booking messages you need.

5. Your responsibilities

Please give accurate booking information, keep your appointments or cancel in good time under the salon’s policy, and treat salon staff respectfully. Do not misuse the Service, for example by making fraudulent or abusive bookings, attempting to disrupt the Service, or using it for any unlawful purpose. We may suspend access that is misused.

6. Your consumer rights

Nothing in these terms limits the rights you have under the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, or other South African law that cannot be excluded. Where those laws give you stronger rights than these terms, those laws apply.

7. Availability and changes

We try to keep the booking service available but cannot guarantee it is always uninterrupted or error-free, and we may change or withdraw features. We are not responsible for a salon’s acts or omissions, or for matters beyond our reasonable control. We may update these terms and will post the updated version; continuing to use the Service means you accept the update.

8. Liability

Sunbird provides the booking platform; the salon provides the service you book. To the extent the law allows, and without limiting your rights under Section 6, Sunbird is not liable for the salon’s services, or for indirect or consequential loss arising from your use of the booking platform. We do not exclude or limit any liability that cannot lawfully be excluded or limited, including liability that the Consumer Protection Act does not permit us to exclude.

9. Governing law

These terms are governed by the law of the Republic of South Africa.
